A Drunk-Driving Arrest

Although a drunk-driving arrest may appear straightforward, there are a number of procedures that police must follow to avoid violating your rights. First, in order to pull a driver over, the police must have a reasonable suspicion they are under the influence. Secondly, if a field sobriety test is done, it must be conducted according to certain prescribed protocols. Next, if a breath test is administered, the breathalyzer must be calibrated correctly, and be in good working order; if a blood test is used, it must be administered by a qualified technician using proper equipment and ensures that the sample is not tainted in any way.

How Can I Challenge the Evidence?
